Delivery instructions and time frames

Orders and requests can be lodged using Web Splash Pty Ltd globally however, shipping of printed materials is restricted to Australia (though the design will be provided electronically to the client.)

The delivery times given on this website are indicative only. Web Splash Pty Ltd will not be liable for any failure to observe these delivery times.

As a rough guideline, here are the time frames within which work should be completed:

 

• Provisioning of any website and email hosting services (24hrs)
• Registration of any domain name or DNS services (24hrs)
• Logo creation (initial drafting phase – up to 4 business days)
• Business stationery set design (initial drafting phase – up to 4 business days)
• Graphic design services (as specified upon job acceptance)
• Website design and development (initial drafting phase – up to 4 business days; project completion – 2-3 weeks)

 

Delivery of any materials will be done using the client’s nominated courier or method of post, with the client liable for any delivery fees and charges.

Credit cards are charged online in real-time, if payments are made from the Web Splash Pty Ltd website. If an offline transaction is lodged, credit cards will be charged at Web Splash’s discrepancy. The client is solely responsible for ensuring that the required funds are available at the time of receipt of the transaction lodgement, and that they remain so until the transaction is processed. The merchant name that will appear on the card holder’s statement (for all online real-time transactions) is Web Splash Pty Ltd.

If a client requests to track the order, Web Splash will update the client’s management interface with comments regarding the status of the order/service provisioning.

You understand and agree that you shall not be entitled to withdraw or modify any commitment made for the purchase of products and services from this website once that commitment has been made for any reason, including without limitation, due to any delay in delivery.

Trademarks and copyright

The copyright and the Trademarks “we paint the web” and the “Web Splash logo” on this website is owned by Web Splash Pty Ltd. No part or parts hereof may be reproduced, distributed, republished, displayed, broadcast, hyperlinked or transmitted in any manner or by and means or stored in an information retrieval system without the prior written permission of Web Splash Pty Ltd. Permission is granted to download and print the materials on this website for personal, non-commercial use only provided you do not modify the materials and that you retain all copyright and other proprietary notices contained in the materials. This permission terminates automatically if you breach any of these terms and conditions. Upon termination, you will immediately destroy any downloaded and printed materials. You also may not, without permission, from Web Splash Pty Ltd, “mirror” any material contained on this website on any other server or anywhere else.

All products and services on this website, unless otherwise stated, are independently provided by Web Splash Pty Ltd, and not by the individual software providers and hardware manufacturers. All references herein are for descriptive purposes only and are not intended to imply any form of endorsement by the individual software and hardware providers.

Refunds and returns policy

If, within 30 days from the date of initial purchase, you decide to change your mind about your purchases and provisioning, you may opt to discontinue any work or products you’ve provisioned. If the initial agreement is breached by the client, the deposit is non-refundable, and any products and services remaining to be delivered may or may not be finalised and delivered, at the discretion of Web Splash Pty Ltd.

Under no circumstances will any refund be provided, excepting extreme cases where the client has been denied products and/or services Web Splash Pty Ltd has been contracted to provide to the client, and where the client has provide timely payments for the products and/or services.

Returns are applicable only to printed material, which is provided as-is direct from the printer. If there are any issues with the quality of the printing, or issues with the finished product, whether a print run will be resubmitted  is solely at the discretion of the print provider. Consideration of returns will be made only within 7 days from start of transit. Where fair reasons are provided for reprint, and Web Splash Pty Ltd has discussed and is in agreement with the views stated by the client regarding printing, Web Splash will plead the case for reprinting. All fees incurred by printing and shipping are the liability of Web Splash’s client(s) in all cases for all deliveries and returns.

If any returns are received in a damaged condition, this will be taken into account when considering errors pertaining to initial printing. All returns must be accompanied with an outline of the issue(s) that the client has found with the printing, and the resolution that would best suit the client.

In the case of a refund, a remittance advice will be provided via email to the client’s nominated email address, provided upon registration at websplash.com.au

Payment plan availability

1. Payment plans are available over a specified term to approved applicants.

General

1. Author’s corrections to the brief or format changes during the project may attract extra charges;
2. All prices quoted/invoiced herein are quoted and invoiced in Australian Dollars (AUD$);
3. Outside the time allowances set out for items detailed in this quote, work is charged at a rate of $120.00 per
   hour.
4. Payments may be made by cash or electronic funds transfer to the following account:

Website and email hosting

1. We specifically exclude any warranty as to the accuracy or quality of information received by any person via the Server and in no event will we be liable for any loss or damage to any data stored on the Server. You are
   responsible for maintaining insurance cover in respect of any loss or damage to data stored on the Server. You warrant to us that you will only use your assigned Web Site for lawful purposes.In particular, you further warrant and undertake to us that:
   1. you will not, nor knowingly or recklessly post, link to or transmit any horise or permit any other person to, use the Server in violation of any law or regulation;
      
   2. you will not transmit material:
      
      1. that is unlawful, threatening, abusive, harmful, malicious, defamatory, violent or teaching violence, obscene, pornographic, profane or otherwise objectionable in any way; or
         
      2. containing a virus or other hostile computer program; iii. that shall constitute or encourage a criminal offence, give rise to civil liability or that violates or infringes any trade mark, copyright, other intellectual property rights or similar rights of any person under the laws of any jurisdiction; and c. you will conform to the standards made available by us from time to time and will not yourself, and will ensure that none of your end users, make excessive or wasteful use of the Server to our detriment or that of our other customers.
2. You are responsible for sending mail in accordance with any relevant legislation, including but not limited to the Commonwealth Spam Act (2003) and for sending the same in a secure manner. We will take all reasonable steps to ensure accurate and prompt routing of messages but we will not accept any liability for non-receipt or misrouting or any other failure of email. In the event of deliberate transmission of unsolicited commercial email (UCE), NetRegistry reserves it right to terminate services without prior notification.
3. You warrant, undertake and agree that:
   1. any transactions within your Web site which are contracts for the sale of goods or services will be between you as the merchant and your end-user customer and you agree that we may include an exclusion of our liability in respect of such purchases and transactions in such form as we deem appropriate;
      
   2. the information contained within your Web site will comply with all applicable law, and codes of practice governing the use of Web sites and related services, including, without limitation, those laws and/or codes of practice governing distance selling and data protection from time to time in force;
   3. you will keep secure any tification, password and other conftial information relating to your account and you will notify us immediately of any known or suspected unauthorised use of your account, or any known or suspected breach of security, including loss, theft or unauthorised disclosure of your password information. Notwithstanding such notification you will be liable for any and all uses of your account (and Web site) notwithstanding any fraudulent or improper use of your password or any other access to any of the
      facilities we offer which is not unauthorised use or access by us.
      
4. Whilst we shall use reasonable endeavours to ensure the integrity and security of the Server, we do not guarantee that the Server will be free from unauthorised users or hackers.
   
5. We do not warrant whatsoever that our virus protection services will stop every virus from reaching your computer network. We make no warranty that the service will be error free or free from interruption of failure, and the company expressly disclaims any express or implied warranty regarding system and/or service availability, accessibility, or performance.
